As regards RUsum1, I thought he had ordered a backup disk from Digital River but since he states above that he had made an order over the phone, it must have been with the MS store and had been ordering the full retail pack they were offering for the Pro version. That package does in fact contain both 32 and 64 bit disks in the same box (package); so when he called back to say he had wanted the 64-bit version of the OS, they told him it had both. Any confusion stems from the fact that if one did a DL, one was told to DL either the 32-bit or the 64-bit install even though the product key would be good for either. And one could order and have sent a backup disk for $13 extra during the ordering checkout. What I don't know is if one would get the 2 disk set or not. Anyway, say goodnight.

OK, thanks ... I guess I said the same thing only differently. If an ambiguity can be read/decided in a manner most fovorable to any party, then it favors none over any other. Thus a non-drafting party can read and apply an ambiguity to his/her advantage, whether or not the drafting party reads it differently. I find this interesting because I would assume there'd be no difference between the effect on drafting and non-drafting parties (if any of the latter), as it is assumed that all parties have read and agreed to all parts of a contract. (Thus, what is the difference who drafted it ... and usually both/all parties have taken part in drafting it anyway? I guess in consumer issues your point might make some difference, as consumer contracts are usually drafted by the supplier.) I also wonder why anyone would be "anxious" to cut off discussion on a thread if he/she is simply not interested in the current line of thought, as long as the material is in some fashion related to the thread content. That's my definition of someone who needs something else to think about, or do. The "sale" is over, but are we really inconveniencing anyone by discussing pertinent "after the sale" matters? |
