dood.. just work w/xbox live support. They're actually some of the best support I've talked to.

When I first signed up, I wanted "Phrozt" (obviously). I checked out the tag, and it hadn't been used in a year... so I'm thinking... "eh.. I might call XBL support and see if there's any chance they will give it to me." So I called up... totally not expecting anything and lay everything out for them.

They actually agreed with me and looked into how I could get that name. Unfortunately, after doing more research on it, they said that it had a certain type of subscription on it bought for a different type of passport account that wouldn't let them transfer it over.

Then, even though it was obvious that it wasn't me, I asked if I could give them some credentials to see if it might be an old account of mine. I rattled off a bit of info and it definitely wasn't... but at least they gave it a shot! I don't know of any other support that would have gone to that length... for a damn gamer tag no less.
